Terms of Service
These Terms of Service ("Terms") govern your access to and use of SPILLHUB (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What SPILLHUB Is
SPILLHUB is a daily anonymous prompt and response experience. Users can submit one anonymous note per day in response to the day's question and, after submitting, view other users' submissions and (optionally) unlock archives or paid features like colored or pinned notes.
2. Eligibility
You may use the Service only if you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into these Terms. By using the Service, you represent and warrant that you meet these requirements.
3. Your Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs from your browser or device, including submissions, hearts, and shares triggered from your session.
4. Anonymous Content
The Service is designed to be anonymous. We do not ask you to create an account or provide your name or email in order to submit notes. However, to operate the Service and enforce one-note-per-day and abuse limits, we may use technical identifiers such as:
- anonymous session cookies (e.g., a hashed browser id),
- IP addresses, and
- basic device or browser metadata.
These identifiers are used for rate limiting, moderation, security, and analytics and are not intended to identify you personally. For more details, see the Privacy Policy.
5. Content You Submit
By submitting content (a "note" or other text) to the Service, you grant The Spill Wall a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, translate, publish, display, distribute, and create derivative works from your content in connection with operating, improving, promoting, and archiving the Service. This includes displaying it on the wall, in archives, and in share cards or previews.
You are solely responsible for the content you submit. You represent and warrant that you have all rights necessary to submit the content and grant the above license, and that your content does not violate any law or third-party rights.
6. Prohibited Content
You agree not to submit any content that includes or promotes:
- hate speech, harassment, threats, or incitement to violence;
- illegal activity or instructions for committing illegal acts;
- doxxing or sharing of private, identifying information about others;
- graphic sexual, violent, or otherwise explicit content;
- spam, commercial advertising, or scams; or
- any content that violates applicable law or the rights of others.
We reserve the right (but are not obligated) to review, moderate, refuse, remove, or archive content at our sole discretion, with or without notice, including for any violation of these Terms or to protect other users or third parties.
7. Moderation and "Wall" Behavior
The Service uses automated and manual moderation to help keep the experience safe and broadly acceptable. This may include:
- basic filters for links, emails, and known abusive terms;
- rate limiting based on IP, session, or device;
- automated or AI-assisted content checks; and
- removal or hiding of content deemed inappropriate.
Moderation is inherently imperfect. Use the Service with the understanding that you may see content you find uncomfortable or disagreeable, and that some content may be removed even if you believe it should stay up. We do not guarantee that any specific content will be displayed or preserved.
8. Hearts, Shares, and Archives
Once you have answered a day's prompt, you may be able to:
- heart other users' notes (an anonymous reaction),
- share a note via a link or share card, and
- unlock access to archived walls as a paid feature.
Hearts are anonymous and are used to help surface content within the Service. We do not publicly display heart counts tied to usernames or profiles. Shared notes may be accessible via a dedicated note URL and may generate a preview image when shared to third-party platforms. Archived content may remain available to users who unlock it, subject to moderation and technical limits.
9. Payments and Paid Features
The Service may offer optional paid features, such as colored notes, pinned notes, or archive access. Payments are processed by third-party providers (such as Stripe), and your use of those services is subject to their terms and privacy policies.
Unless expressly stated otherwise, all payments are final and non-refundable. We may, at our sole discretion, issue refunds or credits in limited cases, but we are not obligated to do so.
We reserve the right to change pricing, introduce new paid features, or discontinue existing features at any time, with or without notice. If you lose access to a paid feature due to violation of these Terms, you are not entitled to a refund.
10. No Therapy or Professional Advice
SPILLHUB is not a therapy service, crisis line, or professional advice platform. Nothing on the Service should be interpreted as medical, psychological, legal, or financial advice. If you are in crisis or need professional help, contact local emergency services or a qualified professional in your area.
11. Intellectual Property
The Service, including its design, branding, logos, prompts, and underlying software, is owned by SPILLHUB or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license granted to you to use the Service, these Terms do not grant you any rights to our intellectual property.
You may not copy, modify, reverse engineer, distribute, or create derivative works from the Service or any part of it, except as permitted by law or with our prior written permission.
12. Third-Party Links and Services
The Service may link to or integrate with third-party sites, services, or content. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
13. Termination
We may suspend or terminate your access to the Service, or remove any content you have submitted, at any time and for any reason, including if we reasonably believe you have violated these Terms or are causing harm to other users, the Service, or third parties.
You may stop using the Service at any time. Because the Service is anonymous and session-based, there is no account to close, but you can clear your browser data or stop visiting the site if you no longer wish to participate.
14. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, SPILLHUB and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any content on the Service; (c) any unauthorized access to or use of our servers or data; or (d) any other matter relating to the Service.
Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify and hold harmless SPILLHUB and its owners, operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.
16. Governing Law
These Terms and any dispute arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of the jurisdiction where the Service is primarily operated, without regard to its conflict of laws principles. You agree to submit to the personal jurisdiction and exclusive venue of the courts located in that jurisdiction for the resolution of any disputes.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date on this page. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
